Terms of Service
These proposed terms cover the Everyday app and website operated by Aditya A, an individual based in Telangana, India (“Everyday”, “we”, or “us”). They are a draft for review and are not yet an effective agreement. Before launch, the final terms and the way you accept them must be made clear. Our Privacy Policyexplains how personal information is handled; accepting terms is not consent to every use of information.
1. Eligibility and your account
The proposed minimum age is 13, subject to higher local age and contractual-capacity requirements. A parent or lawful guardian must provide any legally required authorisation through a valid process; ordinary parental permission does not replace legally required verifiable consent. India’s DPDP framework treats under-18s as children and includes verifiable parental-consent requirements when its relevant provisions commence and apply. The reviewed app has no age gate or verifiable parental-consent process. Eligibility and controls must be resolved before minors are admitted where those controls are required.
Use accurate account information and protect your Google or Apple sign-in account and device. Do not impersonate another person or use their account without permission. Tell us if you believe your Everyday account has been compromised. You are responsible for your own actions and authorised use of your account; responsibility for unauthorised activity depends on the circumstances and applicable law.
2. Using Everyday and keeping your photos
Everyday helps you keep a photo diary and collaborate in shared collections. Subject to these terms, you may use the app and website for their intended personal purposes. The app’s software, design, branding, and other service materials remain the property of their respective owners; using the service does not transfer those rights. Open-source components remain subject to their own licences.
New personal photos rely on your device’s gallery; their metadata and recovery references sync to the backend. Shared photos are uploaded for cloud storage and delivery. Older memories may also use cloud storage. Offline actions may need a later connection to finish. If a gallery file is deleted or permissions are revoked, a memory may no longer be viewable. Recovery metadata is not a backup of the photo itself. Keep your own backups of important photos. Operating-system permissions, device storage, network access, and provider availability can affect features, including reminders.
3. Your content and limited permission to operate the service
You retain your rights in photos and other content you provide. You give Everyday a non-exclusive permission to host, store, copy, process, format, and display that content only as needed to provide the features you request, including syncing metadata and delivering photos to the people you share with. This permission extends to service providers only to the extent needed to perform those tasks. It is worldwide because infrastructure may be in different countries, and royalty-free because neither party pays for this operational permission. It does not transfer ownership or authorise unrelated advertising use.
The permission ends when the content is removed from the service, except for the limited processing needed to complete deletion or meet applicable legal requirements, as explained in the Privacy Policy. Copies other people already saved are not recalled by deletion.
You must have the rights and permissions needed to supply and share your content, including permission concerning other people’s privacy and images when required. Do not assume a photo is lawful to share because it is already on your device. Other members retain their rights in their content; access to a collection does not give you permission to publish someone else’s photos or use them for unrelated purposes.
4. Shared collections and invitations
Adding a photo to a shared collection makes it available to its members. Membership information includes names, email addresses, and profile images. Owners manage join requests, can remove members or photos from the collection, and can delete the collection. Collaborators can leave and remove their own contributions from sharing. These actions can change other members’ access.
Valid invite links reveal limited photo previews to link holders before membership approval. Links can be forwarded, and recipients can save photos, take screenshots, or share copies outside Everyday. Cloud delivery URLs may be accessible to someone who obtains them. Share only content you have permission to share and give links only to people you trust. Respect a contributor’s request to stop using or sharing their photos, subject to applicable law.
5. Acceptable use and reporting problems
Do not use Everyday to:
- Break applicable law or infringe copyright, privacy, or other rights.
- Share child sexual abuse material, non-consensual intimate imagery, or content that unlawfully exploits or harms others.
- Harass, threaten, stalk, impersonate, or deceive another person.
- Access accounts, private content, or systems without permission; bypass access controls or rate limits; distribute malware; or disrupt the service.
- Collect other users’ information or redistribute their content without a lawful basis or necessary permission.
Send content, privacy, copyright, or security concerns to the published contact below with enough information to locate the issue. Do not include unnecessary sensitive material. We may restrict access to content or accounts when reasonably necessary to address a violation, protect people or the service, or comply with law. Where appropriate and legally permitted, we will explain the reason and provide a way to challenge an error. The reporting contact and handling process must be operational before launch.
6. Website answers and external services
Common FAQ questions have preset answers. Custom questions can be answered by a Cloudflare-hosted AI model using your question and public Everyday documentation. Do not submit personal or confidential information. Answers can be wrong and are informational: they do not amend these terms or the Privacy Policy, guarantee a feature, or complete an account or privacy request. Use the published support contact for those requests. Free provider quotas are limited and may affect availability.
Google or Apple sign-in, app stores, your device’s photo backup, and external links are also subject to their providers’ terms and policies. Their independent services may change or become unavailable.
7. Leaving, deletion, and termination
You may stop using Everyday at any time. To delete your account, follow Profile → Delete account while connected and signed in. Deletion is permanent and cannot be undone through the app. Save anything you need before confirming. Signing out or uninstalling does not itself delete your account.
Account deletion removes your authentication account, ends membership, and schedules removal of your memories and associated backend data, including cloud images, with retryable cleanup. An owned collection transfers to another member if one remains, or is deleted if empty. Your deletion does not delete other members’ own memories. Gallery originals and copies already saved by others remain. Analytics, provider logs, backups, and deletion receipts need the separate retention and erasure handling described in the draft Privacy Policy; we do not promise that all copies disappear instantly.
We may suspend or end access for a material breach, a legal requirement, or a serious security or safety risk. Where feasible and lawful, we will give notice and an opportunity to resolve the issue, and reasonable access to save content before a planned service closure. Urgent protective action may need to happen first. Any continued retention must have a lawful purpose. Terms about ownership, responsibility for earlier actions, and dispute resolution continue only to the extent needed after access ends.
8. Availability, responsibility, and consumer rights
We aim to provide a useful and reasonably reliable service, but cannot promise uninterrupted access, error-free operation, or recovery of every photo. Features may change for maintenance, security, or product reasons. Material changes that reduce an agreed service must respect applicable consumer law, notice requirements, and remedies. A future paid offering would need clear pricing and applicable payment terms before you choose to purchase it.
Each party’s responsibility for loss is determined by applicable law, including the cause, foreseeability, and any reasonable steps to limit the loss. Nothing here excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury where it cannot lawfully be excluded, or any other non-excludable liability. These terms do not remove statutory warranties, privacy rights, consumer guarantees, or rights to a refund or other remedy that the law gives you. They impose no blanket indemnity or waiver of claims against Everyday.
9. Changes, questions, and disputes
The final terms will show an effective date. We will provide reasonable notice of material revisions through the app or another suitable channel, explain when they take effect, and obtain renewed agreement where required. Revisions do not retrospectively remove accrued rights. You may stop using the service and request deletion if you do not accept a change, subject to any rights provided by law.
Contact us first if you want help resolving a problem. This does not prevent a complaint to a regulator or a claim in a court with lawful jurisdiction, or require you to delay a statutory remedy. These terms do not require arbitration or waive class or collective remedies. Mandatory local protections remain applicable. If a provision is unenforceable, the remaining provisions continue only to the extent allowed by law.
